If a person has a lot of unsecured debt that has been charged off by the lenders and the person is not eligible for Chapter 7, should they file Chapter 13? What are the benefits of filing Chapter 13 in this situation? Thanks!

I am considering trying to consolidate about 35K worth of unsecured debt, although I’m not having trouble making the payments.

I have decent credit but I had cancelled all my cards when trying to get out of debt. I am now free of all unsecured debt but I need to have a card so in the future I won’t be hurt by having no credit.

I’m thinking I want a card with no annual fee and a low APR. The card would only be used very occassionally and paid off immediately. I have no desire to repeat previous mistakes.

Does anyone have any recommendations for a good card for this purpose?
Okay, as I said, but everyone is skipping, is that I have decent credit. My credit score is 700.

When I got into trouble I went into debt consolidation right away BEFORE my credit got screwed up.

But I do appreciate those of you who are taking the time to answer.

We have mortgage salespeople who aren’t working mortgages due to what’s going on in the economy. We are looking to convert them to unsecured debt consolidation programs, but aren’t looking to do the heavy lifting involved with settling this debt, but rather are looking for some reputable companies who handle all the back end, and are simply in need of fronters like what we have.

I have an unsecured debt and i filed chapter7. On that unsecured debt i have a cosigner, and i know they will come after her, but we have not recieved any bills, nor has she, when will she recieve bills for this debt again, and when will she have to start paying the debt. will she have to start paying immedietly or do we wait until she is contacted?
The co borrower lives with me and it is National City bank that is owed, they have her phone number and they have her address, and this particular bill has never been late and this would be the first month….we have been paying it,,,,but we have stopped recieving the bill.
the bill is still not late….it is current…..so should i call the creditor and tell them to continue sending the bill, and just keep paying it on time, or will the debt have to be reaffirmed into just her name and she starts paying it then….well im still the one paying it

How does a person pay their personal debt while they are in jail? What happens to unsecured debt? I understand that a house would be foreclosed on, that a car would be repossessed, but what happens to other debt? Is the family responsible for paying it?

  • Leida says:

It is my understanding that unsecured debt can not be passed on to your spouse or children when you die. I work in the credit industry and when assisting a client who’s husband or wife has passed away, they usually just fax or mail a copy of the death certificate then the debt is obsolved–as long as there are no other names and/or social security numbers on the accounts of the deceased individual.

Today, I have been told that depending on the state, common laws may allow the debt to be passed on.

    Is this true?

  • Merlin says:

I know a lot of people are filing bankruptcy on credit card debt. I did this myself and got 35,000 dollars worth of credit card debt discharged. That means my credit card companies lost a lot of money on me. I know my credit is ruined but oh well. Unsecured debt should be more difficult to get. It is still easy to file bankruptcy if one meets the means test. Your opinion, please.

I was on a news web-site that allows readers to comment on the stories; the story I was reading at the time was about credit cards.

One comment came from a woman who claims that all unsecured debt expires in 3 or 4 years, depending on state laws, and that you can simply write a letter to the issuer (she suggested having a lawyer do it, to prevent harassment from the credit card company) saying the debt has expired and is no longer collectible. She further claims that doing this does not affect your credit score.

    Is any of this true?

Explain secured and unsecured debt, a mortgage agreement and the parties to such an agreement, and what occurs if there is a default on a mortgage agreement.

Also, when a company is borrowing from a bank for a new building, what type of contract the company is entering into with the bank?

I have debts going back 6 years, for credit cards, unpaid phone bills, unpaid loans, unpaid bank charges and more, I have not paid a penny to another for 6 years, but I keep getting letters to my mums address saying that bailiffs will be coming soon. What should I do to get them off my back, I earn £25,000 a year. Will they accept any amount per month? Should I go on a debt plan? I have £6000 unsecured debt.

Can anyone tell me what personal property is exempt from seizure from an unsecured debt in Pennsylvania?
Hmm, according to every website I’ve seen, they can take you to court and have the sheriff seize property if that’s what the judgment ends up being, even if it’s unsecured debt. Unsecured just means they can’t just take something you bought on their credit card back, they have to take you to court to get a judgment against you. It’s just while most states have this info online as to what can not be taken to Sheriff’s sale, PA does not.

For instance a credit card that is 5 years delinquent. After it’s been sold to a collection agency how long can they collect?
OK,is the statute of limitations in the state you reside or the state the creditor is based in?How long do they have to try and get a garnishment or judgement if living in NY?
Can a collection agency bring you to court after the debt has passed the S.O.L.?

  • Dave says:

I’m being taken to court later this month over an old credit card debt. The credit card company sold the debt to a smaller parasite debt collector. I intend to pay it off at some payments ($100/month, $4500 in total). Should I get a civil lawyer? I don’t want to get steamrolled in court, should I hire a lawyer?

I have about 23,000 in unsecured credit card debt. I recently lost my job and had to take one making a lot less per month. I then have a mortage utilities and insurance etc so i am running in the hole. Is debt settlememt a good alternative. I do not want bankruptcy . I just asked a Q about not showing up in court for a UNSECURED credit card debt. If they get a judgement against her how would they be able to collect because it is a credit card debt and is unsecured. Is everyone telling me once a judgement is served they can now attach wages and property even though this was an UNSECURED DEBT?

If you have credit cards debt in the USA of about $20,000 and you are NOT a USA citizen and you move back to your country (England). What can happen in your opinion, I know the credit cards are unsecured debt. Can they chase you to another country (interpol) or is it just a bad debt? Do you think this will make a problem if I want to come back into the USA as a tourist in the future?
